Are you planning to get married in a simple ceremony without the pomp and show common in the Indian weddings or are you planning a marriage with your partner belonging to another caste, religion or country ? The answer is Court Marriage

As marriage is a subject which falls under the personal law and specific rules related to one’s religion or customs are necessary to be observed in order to have such marriage deemed as legally valid. For couples who wish to go through an inter-caste marriage or inter-religious marriage, the legislature has passed the Specific Marriage Act, 1954, which provided for the provision of Court Marriage.

Conditions for Court Marriage:- 

Provided under Section 4 of the Act of 1954, conditions necessary to apply for a court marriage:-

  • Age required:- 18 years minimum for bride and the groom should be at least 21 years old. 
  • The parties must not be in a valid marriage to any other person, a person may apply for court marriage if he or she is a divorcee or a widow/er.
  • The parties to the marriage should have given their free consent for marriage and shall not be incompetent to offer valid consent due to unsoundness of mind or any other factor. 
  • The parties to the marriage must not fall within the degree of prohibition.

Documents for Court Marriage:-

The Documents necessary for court marriage:

  • Application for marriage should be duly signed by the parties to the marriage.
  • Receipt of the fee paid shall be attached as well.
  • Copy of proof for age of the parties.
  • Proof for residential address of the parties (could be Aadhar card, Voter-ID, Ration Card or Driving Licence).
  • Affidavit
  1. Affidavit solemnising the Date of Birth.
  2. Marital status of the parties.
  3. An affidavit affirming that the couple are not related to each other under the prohibited degree of relationship.  
  • 2 copies of the passport size photos of the bride and groom
  • A copy of order of Divorce or Death Certificate of the spouse in case either of the parties to the marriage is a divorcee or a widow/er.
  • Documents to be submitted by the witness:-
  1. 1 copy of passport size photo.
  2. PAN card.
  3. Identification proof- Driving License, Aadhar Card, etc. 
  • In case either of the party is a foreign national:-
  1. A copy of the passport with a valid visa should be attached.
  2. Documentary proof that either of the parties have been residing in India for a minimum period of 30 days.
  3. An NOC or Certificate for marital status from the concerned Embassy or Consulate situated in India by the foreigner partner.

Conclusion

After the process for court marriage has been completed, a marriage certificate would be issued, proving the validity of the marriage. Court marriage could be solemnised at the office of the marriage officer or at any other place at a reasonable distance from the office of the marriage officer.
