Student Sues Jindal Global Law School After University Fails Him For Using 88% AI Generated Content In Exams 91-8877001993

In a landmark case which may have repercussions for higher education institutions across the world, an LLM student of Jindal Global Law School sues the Law School for his use of artificial intelligence (AI) during examinations. This case highlights the need for regulation of public policy concerning technology, ethics, and educational quality, as to how artificial intelligence ought to be used, and abused, in evaluation of students.

Why in the News?

  • Kaustubh Shakkarwar, enrolled in an Intellectual Property and Technology Laws course at Jindal Global Law School, sat for an exam on the subject of Law and Justice in the Globalising World on May 18. 
  • The legal brief questioned the notion that using AI amounts to plagiarism when the institution did not specifically mention it. The petitioner received an email from the Unfair Means committee that contained the words UMC Case- Submission was 88% AI-generated and a PDF document with no explanation, reasoning, or allegation, just a cryptic phrase.
  • On June 25, the Unfair Means Committee of the University informed Kaustubh Shakkarwar that he had failed in the examination as his answers were created with the help of an AI platform. This was despite the fact that Shakkarwar succumbed to the challenge, the decision was maintained by the Controller of Examinations of the universities.
  • According to the AI detection Turnitin, Shakkarwar's legal team denied in the court document that he used artificial intelligence (AI) in his initial submission. The law text also noted that the use of AI was not specifically and institutionally prohibited.
  • Kaustubh Shakkarwar has now made a move before the Punjab and Haryana High Court against the alleged charges for use of AI in examination that is claimed by the university.

Contentions Raised by Kaustubh Shakkarwar (Petitioner)

  • The student made a point that use of AI in examination was not specifically prohibited by the rules of the school. 
  • He believes that any learning policies developed against cheating in academics are becoming outdated, since the technology advances significantly faster than a human being can ever think of.

Consideration by the Court

  • After this resolution, the controller of examinations endorsed the decision of the committee. In this context, Kaustubh Shakkarwar, for whom the position of a researcher is not new since he had worked for the Chief Justice of India, has approached the Punjab and Haryana High Court, appealing against the claims of AI use.
  • The court has directed Jindal Global Law School to respond to the petition of Kaustubh Shakkarwar and has listed the matter on November 14 for further hearing.

This could lead law schools and other academic institutions to reconsider their policies on the use of technology in educational activities. The result may in fact set the standard for the incorporation of AI into academic activities and many more new policies may come that will be more specific on policies regarding content generated from AI.

The lawsuit embodies a larger confrontation about different school systems and their understanding of technology, as well as the need for such systems to adapt to modern developments.
