Rules On New Labour Code 2025

The Modi government is poised to bring about radical changes in Indian labour laws with the proposed New Labour Code 2025. The focus of these reforms is to simplify and modernize labour laws, increase the social security of employees, and minimize the hassle of doing business for employers.

Some of the most common features discussed in the new labour code are associated with a 4-day workweek, where employees get three days off. This change, however, means longer hours of work for the remaining four days. On the downside, salary structure modifications due to the increased PF deduction may see some impact on the take-home pay, but on the brighter side, better post-retirement benefits.

How Will the Labour Code Be Implemented in Phases?

In order to facilitate a smooth transition, the government will implement the new labour codes in three phases:

  • Phase 1: The first new rules will be adopted by large companies with more than 500 employees;
  • Phase 2: Medium companies with 100 to 500 employees will follow next;
  • Phase 3: Small companies with less than 100 employees shall be given a period of up to two years for compliance.

This staggered structure ensures that those micro, small, and medium enterprises (MSMEs), which form more than 85% of Indian companies, are allowed enough time to adapt to the regulations without excessive financial burden.

Salient Features of the New Labour Codes

The government consolidated 29 central labour laws into four broad acts:

  • The Code on Wages: Ensures minimum wages and timely payment of wages to employees in all industries.
  • The Social Security Code: Strengthens the provisions with respect to PF, gratuity, maternity benefits, and insurance.
  • The Industrial Relations Code: Simplifies dispute resolution mechanisms while enhancing labour relations.
  • The Occupational Safety, Health, and Working Conditions Code: With a focus on workplace safety, employee welfare, and better working environment.

These reforms are meant to interleave employee welfare and employer flexibility and ensure that India’s workforce is protected while giving operational freedom to businesses in pursuit of economic growth. 

Will Employees Work Only 4 Days a Week?

The proposal to introduce a four-day workweek has sparked massive interest. In a nutshell, this is what it entails for employees: 

  • Longer Hours: Employees will now have to work twelve-hour shifts as opposed to the usual eight-nine-hour shifts to meet the forty-eight-hour work week requirement. 
  • Higher PF Deductions: With a higher basic pay structure comes a progressive contribution to the Provident Fund, which can be potentially secured as a long-term investment by the employee. This leads to a gradual reduction in his/her immediate cash receipts. 
  • Improved Work-Life Balance: The introduction of a long weekend generously provides three consecutive days to address mental issues and personal time. 

Nevertheless, this system will remain voluntary, allowing companies to adopt either a four-day, five-day, or six-day workweek according to their need in an industry. The ultimate use of this system will be seen differently across various industries-with the manufacturing, IT, and service sectors possibly opting for varied implementations.

How Will Small Businesses Be Affected?

The small enterprises, which form the backbone of India’s economy, will get approximately two years to adopt the new labour codes. Such an extended timeline will ensure:

  • The MSMEs will not face any serious financial burden due to increased compliance costs, at least for now. 
  • There will be some time for the small firms to scheme and draw a gradual implementation of the requisite workforce and salary adjustments. 
  • They will also get their time for training and awareness regarding the new labour laws and their implementation.

Government and State Collaboration

For effective adoption, the collaboration of the Central Government and State Government will be mandatory. The Labour Ministry is discussing the draft regulations with the states.

Latest Updates on Implementation

  • The first phase will focus on the Code on Wages and Social Security Code. 
  • All states, including West Bengal and Delhi, are expected to complete their draft rules by March 2025. 
  • To ensure uniformity in implementing across India, discussions are being held by the government.
