Myth: Court Marriage Is Not A Proper Wedding 91-8877001993

Court Marriages are marriages solemnised in the court of law in the presence of the marriage officer provided under the Special Marriage Act, 1954. It  allows a couple to have their marriage solemnised and registered at the same time irrespective of their religion, caste, place of birth, ethnicity, etc. A couple could get legally valid without any social or legal restrictions, in addition to this, court marriages are economical and not time taking. Thereby making the Court Marriages as legally valid and a ‘proper wedding’ indeed, in spite of what some might believe.

Court Marriages and Religious Ceremonies

Both the court marriages and religious ceremonies have both advantages and disadvantages each, however both are legally recognised, depending upon the couples how they wish to solemnise their marriage.

If Court Marriages are Proper Wedding ?

The term ‘wedding’ in India, could be generally associated with number of traditional ceremonies, lots of pomp and show, ceremonies which would take a number of days, huge music, food, etc. But in its essence a wedding is a union of couple which is recognised by the society and is valid in legal terms.

Court Marriages are indeed legally valid and the couple has the option of following their rituals as well. Parties who wish to get married in an intimate setting and in the presence of their loved ones may opt to marry in the court. Thus, in conclusion court marriages are proper wedding recognised by the law of the land.

How Does a Court Marriage Compare to a Religious Ceremony in Terms of Rituals and Traditions?

When comparing court marriage to a religious wedding in terms of rituals and traditions, it is important to note that court marriage is a legal procedure focused on solemnizing and registering the union, while religious ceremonies are rooted in cultural and religious customs.

Advantages of Court Marriage:

  • It could be considered as an economical and hassle-free alternative to the  traditional marriages
  • Couples belonging to different backgrounds could get their marriage solemnised under the Act of 1954
  • Court marriage offers a valid proof of marriage as recognized by the law -
  • Court Marriages could be solemnized regardless of one’s religion, caste, or race, as customary marriages fall under personal laws.

Disadvantages of Court Marriage:

  • Could be lack of cultural traditions and rituals, however it could be amended as the parties later on can still marry according to their customs.
  • There will be limited social acceptance or stigma attached to the marriage as compared to traditional weddings
  • A court marriage may not offer the similar level of emotional or sentimental value as offered in a religious ceremony

Even though Court Marriages do offer practical solution and legal validity to the marriage, they do lack to some extent the cultural implications as well as emotional significance which could be associated with the traditional weddings, as there would be involvement of the entire family to a larger extent.
