Myth: Court Marriage Doesn’t Require Any Formalities 91-8877001993

In India, Court Marriage are the marriages which are solemnised under the Special Marriage Act, 1954. A couple from any caste, religion or nationality will be able to have their marriage solemnised in the presence of a Marriage Officer as well as three witnesses. This Marriage Officer would generally be the Sub-Registrar appointed as per  the Act of 1954. Now, there is a misinformation related to the Court Marriages that there are no formalities required for it, which is obviously not correct, as shall be discussed in this blog.  

Court Marriage- Introduction

A court marriage is solemnised as per the procedure put down in the Act of 1954 and is similar across India. The marriage officer will perform the marriage without any  discrimination on the basis of caste, creed or religion of the parties applying for it. The bride and the groom will have to submit a court marriage application to the marriage officer in order to receive their marriage certificate. The entire process could be summarised as-

Process of Court Marriage in India

The process of court marriage in India includes numerous steps-

  • 1. Notice of intended marriage
    The couple willing to marry through court would have to submit a notice to the office of the Marriage Registrar in the respective district where either of the partner lives. The notice would have to be submitted before a period of at least 30 days from the intended marriage date. 
  • 2. Waiting period after the Notice
    The notice for the marriage will be displayed for  a period of 30 days at the office of the registrar to raise any objections against the said notice. 
  • 3. Document verification
    The Marriage Registrar would verify the documents submitted by the couple during the waiting period. 
  • 4. Scheduled Appointment for the Marriage
    After verification of the documents is completed, the couple would receive a date to have their marriage registered. 
  • 5. Marriage ceremony
    The couple, in the presence of three witnesses, would have to appear before the Marriage Officer on the set and sign the declaration for marriage. 
  • 6. Marriage certificate
    At the end of the process, the marriage officer will issue the marriage certificate,  signed by both parties to the marriage as well as three witnesses. It would take a period of 15-30 days to issue the certificate. 

Documents Required

Some of the documents necessary for a court marriage are: 

  • Application form for court marriage 
  • Proof of age of both partners
  • Evidence for residential address of both parties
  • Affidavit
  • Passport size photograph of both the bride and groom
  • Copy of the divorce order from in case either of the parties is a divorcee
  • Death certificate of the previous spouse in case of a widow/widower

The minimum age for bridegroom is 21 years while for the bride, it is 18 years. It is also necessary that both parties must willingly give their consent to the marriage. 

If No Formalities Are Required for Court Marriage ?

No this is not true, as the court marriage could be considered as a simple process in comparison to traditional weddings, however they do require certain legal formalities such as the submission of necessary documents, filing a notice for the intended marriage, as well as appearing before the marriage registrar with witnesses in order to have the marriage legally solemnised. Court Marriages do away with the elaborate religious ceremonies but proper documentation and legal procedures would still be required to be followed.
