In a significant judgment, the District Consumer Disputes Redressal Commission in Bangalore ruled that Dil Mil Matrimony should reimburse a customer a total of 60,000 rupees for not finding appropriate spouses for his son as was advertised in their service. The bench consisting of President Ramachandra MS, members Nandini H Kumbhar and Savitha Airani, held that the inability of Dil Mil Matrimony company to meet its commitments was a service defect and was an unfair trade practice.
What is the Case?
- In the case of Sri Vijaya Kumar KS vs Dil Mil Matrimony, the complainant Vijaya Kumar KS approached Dil Mil matrimony company on 17 March 2024 paying ₹30000 with a promise to get a suitable bride for his son within 45 days.
- Kumar, however, did not receive any of the prospective matches from the site after following up many times. When he called for help and finally asked for a refund, the reps of the company purportedly rudeness to him and rejected to grant his request.
- On May 09, 2024, Kumar served a legal letter calculating the refund. No response led him to lodge a complaint with the district consumer forum requesting compensation for the trouble and full payment return.
Observation of the Court
- The Commission evaluated the marketing campaigns of Dil Mil Matrimony which offered “genuine matchmaking services” by suggesting appropriate matches from a database of applicants. It stated that the website was “obligated to disseminate information” concerning registered members to other users but did not fulfil this obligation.
- The commission said, “The opposite party failed to provide any evidence marriage nor a single profile was sent to the plaintiff or otherwise.”
- In view of Dil Mil Matrimony's non-appearance before the court, the Commission heard the matter ex parte and concluded the conduct of the Company amounted to insufficiency of service and unfair trade practice to the detriment of the consumers' trust.
Decision by the Court
- The consumer court directed Dil Mil matrimony to award refund of the first payment made by complainant which was paid 30,000, with interest included.
- Further, the commission granted the complainant and ordered compensation by the matrimony company, an additional sum of Rs. 20,000, as a replacement for the trouble suffered, 5,000 for distress and 5,000 for costs owing to the suit summing to Rs. 60,000 as compensation.
Legal Implications of the Case
- This situation of compensation by the matrimony company highlights the responsibility of dating platforms and similar service providers to deliver as marketed or otherwise be liable in court in line with consumer protection laws.
