How Will UCC Affect Muslims?

The Uniform Civil Code (UCC) has been a controversial topic in India, particularly concerning its impact on the Muslim community. The UCC aims at replacing personal laws based on religious scriptures and customs by a common set of laws governing marriage, divorce, inheritance, and adoption for all citizens irrespective of their religion. While supporters believe that it will restore gender justice, critics fear that it may infringe upon minorities' rights regarding the freedom of religion and their cultural identity.

  • Hindus, Sikhs, Jains, and Buddhists work under the aegis of the Hindu Marriage Act and Hindu Succession Act.
  • Muslims work under Islamic laws derived from the Quran, Hadith, and Sharia, as laid down in the Muslim Personal Law (Shariat) Application Act, 1937.
  • Christian and Parsis have separate personal laws.

The implementation of the UCC would mean that all these personal laws based on religion would be done away with and substituted with a single Islamic law for all citizens.

Impact of UCC Muslim Personal Law

The most important argument over the UCC regards its impact on Muslim personal law. Some areas affecting marriage due to UCC include: 

Marriage and Divorce:

  • Under Muslim law, marriages are contracts governed by concepts such as nikah, mehr (dower), and triple talaq.
  • The Indian constitution has ruled triple talaq as unconstitutional, giving a turning point to reform. Besides, further reform may take place with the UCC requiring uniformity in divorce procedures.
  • Polygamy, extended only under Islamic law, could lack the legitimacy or could be superseded under the provisions of the UCC, as such practices would have to embrace monogamy for all.

Inheritance and Property Rights

  • Islamic inheritance laws differ vastly from Hindu and Christian succession laws. Under Shariat a daughter received half the share of a son; a wife got one-eighth share from her dead husband's estate.
  • The UCC allows equal rights to inheritance for sons and daughters, which may be seen by some Muslims as affecting their religious law.

Adoption and Guardianship

  • Complete adoption is not recognized by Islamic law like the Hindu Adoption and Maintenance Act; guardianship, however, was recognized.
  • The UCC may put uniform adoption law in place, allowing Muslims to legally adopt a child with full right and duties, rather than only acting as guardians.

Criticism from the Muslim Community on UCC

Concerns around the UCC have been voiced by Muslim scholars and organizations, including the All-India Muslim Personal Law Board (AIMPLB): 

Threat to Religious Freedom:

  • Article 25 of COI guarantees the right to practice and propagate religion, and opposition criticizes the UCC for encroaching upon religious practices protected by this provision.
  • Some Muslims fear that whatever standard law is imposed will dilute their religious identity and customs.

Lack of Representation in Drafting the UCC:

  • It is said that Muslim scholars, jurists, should have participated in formulating the UCC so that it caters to their concerns.
  • No consultation with the religious leader in imposing the UCC from the top could lead to resistance and turmoil.

Potential for Political Misuse:

  • The inquiry about UCC often times has been politicized. There are fears that it is used as a weapon against Muslims, not in the spirit of genuine gender justice.
  • Selective application of reforms like putting restrictions on tripe-talaq ignores problems with women in other religions; thereby it raises suspicion.

Arguments in Favor of UCC for Muslims

Gender Justice and Women’s Rights:

  • The UCC could put a stop to many discriminatory practices against Muslim women, such as polygamy and unequal inheritance rights.
  • The UCC could offer Muslim feminine with the same judicial protection Hindu and Christian women already have under their respective personal laws so they would enjoy something equal to or very close to their male counterparts.

Simplification of Legal Procedures:

  • Different personal laws often lead to complications for instance regarding inter-faith marriages, which a uniform civil code could put to rest. It would provide clarity to all citizens from a legal viewpoint.
  • Uniformities of laws could also lessen judicial workload and disputes concerning personal laws.

Strengthening National Unity:

  • It would be a commendable attempt in facilitating the idea of national unity by providing Hindu or Muslim citizens equality under one law, irrespective of religion.
  • It could help build a more secular and progressive legal system, aligning with the vision of equality enshrined in the Constitution. 

Global Perspective on UCC

  • Numerous Muslim-majority countries have proposed changes in personal laws without a complete break from religious traditions, including Turkey and Tunisia, which have secularized personal laws by abolishing polygamy and introducing regulated succession rights, whereas in Indonesia and Malaysia, Sharia has become a modified version catering to modern legal order.

The impact of the Uniform Civil Code on Muslims is complex. It can exercise benefits and challenges. It will furnish gender equality and legal uniformity; nevertheless, it also stirs serious questions regarding religious freedom and identity. A balanced and inclusive approach with the participation of the Muslim community itself is vital if the UCC is to be endured as a package of justice and equality for all and not as a burden.
