Engineer Rashid Is Granted Parole By A Delhi Court So That He Can Swear In As Baramulla MP

A Delhi court allowed and granted the detention parole to Engineer Rashid, a famous and well-known politician from the Jammu and Kashmir constituency, in a landmark legal as well as geopolitical victory. Rashid can now take his oath of office to become the Member of Parliament (MP) for the northern Jammu and Kashmir constituency of Baramulla as a consequence of this decision.

Who is Engineer Rashid?

  • The founder of the Jammu and Kashmir-based Awami Ittehad Party is Abdul Rashid.
  • He was elected as an MLA twice, in 2008 and 2014, from the Langate constituency in the former Jammu and Kashmir.
  • The moniker "Engineer Rashid" was first used by Abdul Rashid in 2008, following his resignation from the construction industry. It was claimed that he won the Langate constituency following a 17-day campaign.
  • Engineer Rashid is being held in Delhi's Tihar Jail on charges of financing terrorism. The National Investigation Agency (NIA) detained him in 2019 on suspicion of supporting terrorism, making him the first known figure to be detained under the Unlawful Activities (Prevention) Act.
  • His two sons, Asrar and Abrar Rashid, led their father's election campaign. From the size of the crowds at the rallies, they had given the impression that they trusted his father to get the most votes.

Why in the News Today?

  • Engineer Rashid, the MP for Kashmir, was given two hours of Parole by Delhi Court Patiala House on July 2, allowing him to take the oath of office on 5th of July as the member of parliament.
  • To take an oath as an MP, Rashid had requested custody parole or interim bail.
  • In the Lok Sabha Elections of 2024, Abdul Rashid, also referred to as Engineer Rashid, was victorious as an independent candidate, defeating Omar Abdullah, the previous chief minister of Jammu and Kashmir.
  • On July 5, Judge Chander Jit Singh granted him two hours of custody Parole to Engineer Rashid, subject to certain requirements, so he could take an oath.
  • Among them was a two-hour custody Parole to Engineer Rashid, or until the end of the proceedings, whichever came first. Travel time was not included in the two hours that were allotted.
  • It stated that Rashid was prohibited from using a phone or the internet during the oath-taking process, but his wife and kids could be there with proper identification.
  • The court further ordered that he would only communicate with the relevant officials and refrain from speaking to or addressing the media on any matter.
  • According to the court, his family was told not to take pictures at the event or share them on social media.
  • The NIA's attorney did not dispute Rashid's argument on Monday, but instead suggested that there be restrictions placed on his taking an oath, such as refraining from communicating to the media and finishing all the procedures in a single day.
