The Delhi High Court on Thursday, while deciding the case of [Simran Kumari v Bar Council of India & Anr], has asked the Bar Council of India (BCI) to decide within a period of six weeks regarding the matter of payment of a minimum stipend to the junior lawyers who are employed by the advocates, senior advocates as well as law firms.
The PIL was filed by Advocate Simran Kumari, challenging the present stipend policy for the junior advocates employed by the senior advocates.
A Bench headed by the Acting Chief Justice Manmohan and Justice Tushar Rao Gedela, while expressing the urgency of the matter and the necessity of a timely decision by the BCI held that “The Court directs the Bar Council of India to decide on the petitioner's representation as promptly as possible, preferably within six weeks, in accordance with the law”.
Advocate Preet Pal Singh, who was representing the BCI in the case, informed the Bench that in the last meeting of the lawyers' body the related issue was discussed, however has been postponed. He also assured that Court that the BCI would address and resolve the matter in accordance with the law.
