The recent death of an AI engineer, Atul Subhash, who committed suicide on 9th December, has reignited fiery discussions around the nation raising concerns over misuse of several legal provisions especially Section 498A of the Indian Penal Code. Atul’s suicide has once again sparked the debates over false allegations faced by men and the in-laws during divorce and maintenance proceedings.
Atul Subhash suicide case:-
- Atul Subhash who was employed at a private company in Bangaluru, committed suicide while leaving a detailed 24 page note explaining the years of emotional trauma he went through due to marital problems.
- The accused, in addition to his wife and her family members, has also accused a Family Court Judge in Jaunpur, Uttar Pradesh, of harassment, extortion and corruption.
- Bikas Kumar, brother of the accused, has filed a complaint at the Marathahalli Police Station in Bangaluru, based on which a FIR has been registered under Section 108 and Section 3(5) of the BNS. the accused include, Nikita Singhania (wife), Nisha Singhania (mother-in-law), Anurag Singhania (brother-in-law) and Sushil Singhania (wife’s uncle).
- The body of the deceased was found on monday at his Manjunath Layout residence, with a message “justice is due” on a placard.
- A 80 minutes long video of the victim was recorded on Rumble where he explained his decision.
- Atul stated on his video that “I feel that I should kill myself because the money I earn is making my enemies stronger. That same money will be used to destroy me, and this cycle will keep going”.
- The couple got married in the year 2019 and had a son in the following year.
- In july, the Jaunpur Family Court, Uttar Pradesh directed Atul to pay a monthly sum of Rs 40,000 as maintenance for the child, while no compensation was to be paid to the wife.
- The family of the deceased alleges that atul was harassed with financial demands, the family initially requested Rs 40000 monthly, which later increased to Rs 1 lakh.
Arrests in the case:-
- The police arrested the mother and brother of the wife from Allahabad, while Nikita Singhania, the wife was arrested from Gurugram, Haryana, who have been taken to Bengaluru for processing.
- The family members have been put into judicial custody for 14 days at the Central Prison, Parappana Agrahara.
- The accused in the FIR, Sushil Singhania, aged above 70, has been granted bail from the Allahabad High Court and his role in the death is currently being investigated.
Statement from the wife
- Nikita Singhania denied the allegations of harassment by her husband in the suicide note. When interrogated, she claimed that she had separated from her husband for almost 3 years.
